Interim bail application being CRL.M.(BAIL) 1218/2023 was filed on behalf of the Applicant during the pendency of this regular bail application. On 26.09.2023, it was submitted on behalf of the Applicant that surgery of his mother was scheduled for 01.10.2023. Directions were issued for verification of the said fact and the matter was listed for 27.09.2023. On 27.09.2023, this Court after looking into the verification report had granted interim bail to the Applicant for a period of 10 days from the date of release, subject to the conditions mentioned therein, one of them being that Applicant shall surrender immediately after expiry of 10 days from the date of his release.

As a matter of fact and record, Applicant has not surrendered till date and this is despite the fact that on 16.11.2023, learned counsel for the Applicant had submitted that he had not surrendered even on that day and he had advised his client to surrender. It is clear and obvious that the Applicant has misused the concession and liberty granted by this Court by way of an interim bail for 10 days and has not surrendered till date. 3.

Accordingly, Bail Application along with pending application is dismissed.

Needless to state that if the Applicant surrenders, he will be at liberty to apply afresh for regular bail, in accordance with law.
