By this writ petition the petitioner prays for service benefits under Section 10 of the Delhi School Education Act, 1973 on the ground that petitioner is entitled to service benefits from the respondent no. 1/school equivalent to an employee of a government school.

It is undisputed position that as against the petitioner certain disciplinary proceedings were initiated and the petitioner has been inflicted with the punishment of dismissal from services. This order W.P.(C) 4050/2003

imposing penalty of dismissal from services has been challenged by the petitioner and the issue is sub judice.

It is only after the proceedings in the disciplinary case achieve finality, and the petitioner succeeding the disciplinary case or otherwise succeeding to the extent of her service benefits not being affected, would there arise the necessity of deciding this case on merits. 3.

In view of the above, this writ petition is disposed of with liberty to the parties to revive this petition on final conclusion of the disciplinary case against the petitioner.
