The present application has been filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail in FIR No. 0004/2021: registered at Chhawala, Dwarka, Delhi for offence under Section 302 of the Indian Penal Code, 1860.

The learned Trial Court by its order dated 18.05.2021 had dismissed the application filed by the applicant seeking release on the bail observing as under:

"After hearing both the sides at length, I am of the considered opinion that the possibility of intimidation of the minor son of the accused by him as well intimidation of independent public witness cannot be ruled out if the accused is granted bail at this initial stage."

Admittedly, now much water has flown, inasmuch as, many witnesses, including public witnesses, have been examined. 4.

liberty to the applicant to approach the learned Trial Court afresh for seeking bail. In case such an application is moved by the applicant, the learned Trial Court is requested to decide on the same expeditiously and within a period of six months of the filing of the same and of the first listing of the trial before it post this order. 5.

Copy of this order be sent to the learned Trial Court for ensuring compliance.
