O.M.P.(MISC.)(COMM.) 191/2020 2.
This is a petition filed under Section 29-A of the Arbitration and Conciliation Act, 1996 seeking extension of time for completion of arbitration proceedings and rendering of award. 3.
Learned counsel for the petitioner submits that upon disputes having arisen between the parties in respect of Agreement No.02/EE/PD-II/2012-13, arbitration was invoked, and a sole Arbitrator was appointed on 03.08.2017. He submits that despite the parties diligently participating in the arbitration proceedings, the same have remained inconclusive and, in the meanwhile, the mandate of the learned Arbitrator has expired on 21.02.2020, after having been
extended on two earlier occasions. He, therefore, prays that the time for completion of the arbitration proceedings and rendering of award be extended suitably.
4.
Issue notice. Mr. Tanveer Ahmed Ansari, Advocate accepts notice on behalf of the respondent and does not oppose the present petition.
5.
In view of the aforesaid stand taken by the learned counsel the respondent as also the fact that much time and labour has already been spent in the arbitration proceedings, the time for completion of arbitration proceedings and rendering of award is, with the consent of the parties, extended by one year reckoned from 22.02.2020. The extension of one year is being granted in view of the peculiar circumstances prevailing presently, when the regular functioning of this Court stands suspended on account of the pandemic of COVID19. Thus, the mandate of the learned Arbitrator stands extended till 21.02.2021.
6.
The petition stands disposed of.
