Learned counsel appearing for the petitioner submits that M/s. Guild Builders Private Limited had filed an appeal impugning the judgment dated 31.08.2020 being FAO(OS)(COMM) 105/2020 and the Division Bench by order dated 04.09.2020 had directed status quo with regard to the subject shares.

Learned counsel submits that today petitioner has received an email contending that the shares already stand de-pledged. He submits that petitioner is not aware as to when the shares were de-pledged. 4.
Learned counsel for the respondents who appears on advance MAGGU to HMJ Sanjeev Sachdeva.

notice submits that shares were de-pledged on 03.09.2020 and prior to the same an email was also sent to the petitioner of the same date. 5.
Learned counsel for the petitioner disputes the same, however, seeks leave to withdraw the petition with liberty to apply afresh after the disposal of the appeal before the Division Bench, if need so arises. 6.
Petition is accordingly dismissed as withdrawn. All rights and contentions of parties are reserved.
