% 23.05.2019 CRL.M.A.11104/2019 Allowed, subject to all just exceptions. The application is disposed of.
CRL.REV.P. 616/2019 1.
Learned counsel for the petitioner submitted that he is not pressing for the cross-examination of PW-2 and only wants to cross-examine PW-3.
2.
Learned counsel for the petitioner, on the query of the Court, also submitted that he wants to ask whether the date of birth of the prosecutrix was recorded in the school of PW-3 on the basis of some documents or oral statement or as per the declaration of the father of the prosecutrix. 3.
The evidence has been read over by the learned APP.
4.
I do not find any cause or reason to allow any further cross-examination of PW-3 to the petitioner for the purposes of asking the questions as stated hereinabove in this case. The order of the Trial Court in this regard is well-reasoned and no further elaboration is required. Even otherwise, there is no ground made out to allow the petition or to pass a direction for the further cross-examination of PW-3.
5.
I do not find any flaw or infirmity in the impugned order. The petition is accordingly dismissed.
