Petitioner is plaintiff before the learned Trial Court and has filed a suit seeking recovery. It is aggrieved by order dated 06.12.2023 whereby unconditional leave to defend has been granted to its adversary.

Learned counsel for the respondents has also joined the proceedings through video conferencing.

CM APPL.22828/2025 (filed on behalf of petitioner seeking substitution of the name of petitioner from 'Millfields Developers Private Limited' to 'Zuri Hospitality Private Limited) For the reasons stated in the application and after hearing learned counsel for the respondents, the present application is allowed. After hearing arguments for some time, Dr. Abhimanyu Chopra, learned counsel for the petitioner/plaintiff, without prejudice to their rights and contentions, and since the case is now already at the stage of trial, does not press the present petition anymore. He, however, seeks a direction to the learned Trial Court to expedite the trial. 2.

In view of the above statement made by Dr. Abhimanyu Chopra, learned counsel for the petitioner, the petition is disposed of as not pressed. All the rights and contentions of the parties are left open. 3.

Learned Trial Court is requested to make best endeavour to decide the abovesaid suit as expeditiously as possible. 4.

All the pending applications also stand disposed of accordingly.
