BAIL APPL. No. 2547/2020 & CRL. M.A. No. 12320/2020 (for interim relief) The applicant, who is accused in case FIR No. RC/DST/2017/ A/0014 dated 21.06.2017 registered under sections 420/468/471/120B IPC read with sections 13(2)/13(1)(d) of the Prevention of Corruption Act 1988 at PS : CBI/STF/New Delhi, seeks anticipatory bail under section 438 Cr.P.C.

It transpires however that the applicant had moved an application under section 439 Cr.P.C. before the learned Special BAIL APPL. No. 2547/2020 Page of

Judge, seeking regular bail, which has been dismissed vidé order dated 03.09.2020.

In view of the above, after making some submissions, Mr. Ramesh Gupta, learned senior counsel on instructions of Mr. Rinku Kumar Garg, learned counsel appearing for the applicant, seeks leave to withdraw the present application, with liberty to file afresh for bail, at the appropriate stage, in accordance with law. 4.

Accordingly, the present application is dismissed as withdrawn, with liberty as prayed for.
