The present petition has been filed by the Petitioner- Murtja under Article 226 of the Constitution of India, inter alia, seeking issuance of an appropriate writ directing the Respondents to allow the Petitioner to peacefully vend at his designated spot i.e.,vacant land near pavement on the service road, near Gauri Shankar Mandir, Cycle Market Road, Chandani Chowk, City- SP Zone, Ward 84-N.

It is informed on behalf of the MCD that the Petitioner is vending in a no vending area.

If so, let the Assistant Commissioner, MCD of the concerned area identify a space from where the Petitioner can vend. Upon such location being identified, the Petitioner shall move there immediately and shall continue to vend from such spot.

Since the category of the Petitioner is 'Others', the Petitioner is permitted to run the vend at the vending site, strictly in accordance with the terms and conditions of the CoV.

The Petitioner shall also maintain proper cleanliness and hygiene in and around the cart which he is using.

The above stated directions shall be subject to any plan which the Town Vending Committee-II may be coming up with in terms of Section 21 of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 and no vested rights shall be claimed. 12.

So long as the Petitioner adheres to the terms and conditions of the CoV, he shall not be disturbed.

The petition is disposed of in the above terms. Pending applications, if any, stand disposed of.
