The present petition has been filed under articles 226 and 227 of the Constitution of India seeking the following reliefs: " a) Issue an appropriate writ, order or direction directing the Respondent i.e.

Learned Debts Recovery Appellate Tribunal, Delhi to expeditiously hear and decide Misc.

Appeal No.22/2025 titled Standard Chartered Bank Vs. M/s Top Exports & Anr. arising out of S.A. No.370/2024, within a fixed and timebound period as may be deemed fit and proper by this Hon‟ble Court;

b) Direct Respondent to take up Misc.

Appeal No.22/2025 on priority basis and ensure that unnecessary adjournments are not granted to any party;

c) Direct Respondent to consider and decide the pending praecipe/application seeking urgent hearing filed by the PetitionerBank at the earliest possible opportunity; d) Direct Respondent to conduct continuous and effective hearing of Misc.

Appeal No.22/2025 keeping in view the urgency involved and the pendency of connected proceedings before the learned DRT-III, Chandigarh;

e) Pass an order directing that till effective consideration of Misc. Appeal No.22/2025, the connected proceedings arising out of S.A.

No.370/2024 pending before the learned DRTIII, Chandigarh may not be finally adjudicated, so as to protect the statutory remedy available to the Petitioner- Bank;

f) Pass any other or further order(s), direction(s) or writ(s) as this Hon‟ble Court may deem fit, just and proper in the facts and circumstances of the present case and in the interest of justice."

Learned counsel appearing on behalf of the petitioner submits that despite passage of considerable time, proceedings in MISC. Appeal no. 22/2025 are still pending before the learned Debts Recovery Appellate Tribunal, Delhi (hereinafter referred to as „DRAT‟). He further submits that appropriate directions may, therefore, be issued for expeditious disposal of the aforesaid proceedings.
