The present petition is filed under Section 482 of the Code of Criminal Procedure, 1973 seeking quashing of FIR No. 255 dated 15.06.2021 under Sections 188/283/34 of Indian Penal Code ('IPC') and Section 51(b) of the Disaster Management Act, 2005, registered at police station Vivek Vihar. 2.

The learned counsel for the petitioner submits that the present FIR in relation to other co-accused persons has already been quashed by the order dated 01.03.2024 passed by a Coordinate Bench of this Court in CRL.M.C. 3784/2022. 3.

He submits that the role alleged against the petitioner is similar to the petitioners in CRL.M.C. 3784/2022. The said fact is fairly not disputed by the learned Additional Public Prosecutor for the State.

In view of the above, the FIR No.255/2021 is quashed qua the petitioner, subject to payment of cost, of ₹ 7,500/- to Delhi Police Welfare Fund and ₹ 7,500/- to Shahdara Bar Association, by the petitioners, within a period of four weeks from today. 6.

Let the proof of deposit of cost be submitted with the Concerned Investigating Officer / SHO.

The petition is allowed in aforesaid terms.

All pending applications stand disposed of.
