The learned Trial Court acquitted the accused solely for the reason that the eye witness who is the person riding the offending vehicle failed to depose in regard to the manner of offending vehicle being driven.

The learned APP for the State submits that the witness was not the victim. He submits that it is undisputed that one person has lost his life due to the accident being caused by the respondent. He submits that other corroborative evidences in the form of inspection report were sufficient to prove beyond the reasonable doubt that the respondent was driving in rash and negligent manner.

The matter requires consideration.

In view of the above, the leave to appeal is granted and the appeal be numbered as Criminal Appeal ............/2025 (to be numbered).
