This petition is preferred on behalf of the Petitioner under Section 29A (4) and (5) of Arbitration and Conciliation Act, 1996 ('1996 Act') seeking extension of mandate of learned Arbitral Tribunal by a period of 05 months.

Disputes having arisen between the parties in relation to a Business Transfer Agreement dated 29.01.2022, this Court in O.M.P. order dated 10.02.2023. Twelve months period from the date of completion of pleadings expired in July, 2024 and with the consent of the parties, learned Arbitrator vide order dated 08.08.2024 extended the mandate by six months upto 01.02.2025. The arbitral proceedings are stated to be at the stage of Cross-Examination of CW-1.

Mr. Nitin Ahlawat, learned counsel accepts notice and on instructions, submits that Respondent has no objection to the extension of the mandate of the learned Arbitrator by six months.

With consent of the parties, mandate of learned Arbitrator is extended by a period of 06 months from 28.04.2025 and period between 02.02.2025 to 27.04.2025 is regularized.

Petition is disposed of in the aforesaid terms.
