The Petitioner seeks transfer of Complaint Case No. 326/2019, titled Easy Trip Planners Pvt. Ltd. vs. Arzoo.com (India) Pvt. Ltd. & Ors., which is pending consideration before the Court of Judicial Magistrate First Class (NI Act), Shahdara, District Karkardooma Courts to the Court of Judicial Magistrate First Class (NI Act), East District, Karkardooma Courts. The said complaint is filed under Section 138 of the Negotiable Instruments Act, 1881.1 2.
The afore-noted request is made in light of the fact that there are other complaint cases filed by the Respondent arising out from the same transaction which are all pending before the Court of competent jurisdiction in the East District, Karkardooma Court.

Although, counsel for the Respondent contends the transaction in Complaint Case No. 326/2019 is different, nonetheless, he has no objection to the prayer made in the petition, having regard to the fact that the parties are same and the cases pertain to NI Act. Accordingly, this Court is inclined to grant the relief sought in the petition.

In view of the foregoing, the petition is allowed and it is directed to transfer the Complaint Case No. 326/2019, titled Easy Trip Planners Pvt. Ltd. vs. Arzoo.com (India) Pvt. Ltd. & Ors., which is pending consideration before the Court of Judicial Magistrate First Class (NI Act), Shahdara District Karkardooma Courts to the Court of Judicial Magistrate First Class (NI Act), East District, Karkardooma Courts.

Accordingly, the petition is disposed of.
