In pursuance of the order passed by the Pre-Sitting Lok Adalat dated 25.09.2025, Mr. Sameer Nandwani, learned counsel for the appellant, submits that he has instructions to withdraw the present appeal. 2.

Ms. Shabiesta Nabi, learned counsel for respondent No. 1 - claimant, submits that respondent No. 1 had filed a reply to the appeal alongwith cross-objections on 11.10.2024. The Registry reports that the said reply, filed under Diary No. 4505899/2024, has been returned under objection.

Since Mr. Nandwani seeks to withdraw the appeal, and the crossobjections are not presently on record, I do not consider it necessary to keep the present appeal pending.

challenge the impugned award, he may do so by way of an independent appeal, wherein all rights and contentions of the parties, including those relating to limitation, are left open.

Accordingly, the appeal is dismissed as withdrawn in terms of the aforesaid directions.

The statutory deposit of Rs, 25,000/- be refunded to the appellant.
