HON'BLE MS. JUSTICE JYOTI SINGH
O R D E R
% 20.11.2025 1.
This writ petition is filed on behalf of the Petitioner under Article 226 of the Constitution of India seeking the following reliefs:- "a. Issue writ of mandamus or any other appropriate writ, Order or directions to the Respondent No. 1 and 2 to blacklist the respondent no 3 alleged college from running any educational courses, be it B.Ed and D.ED.LD etc. in view of the fact that the respondent No 3 college has suppressed the material facts and misled this Hon'ble Court about existence of the alleged college.
b. Issue writ of mandamus or any other appropriate writ, Order or directions to the Respondent no 1, 2 and 4 to set an enquiry on the existence of the respondent no 3 alleged college to find out as to whether the alleged college ever existed, if not and then on what ground, the alleged College filed a Writ Petition being 11455/2024 before this Hon'ble Court seeking a direction to decide the application dated W.P.(C) 5412/2025 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. 05.07.2024 of the respondent no 3 for shifting of its premises from plot No 119,120, Village Telhara Khurd , Dhaka, East Champaran, Bihar. c. Pass any other necessary/appropriate directions in the matter as the Hon'ble Court may deem fit and proper in the interest of justice." 2.
Learned counsel for the Petitioner is unable to satisfy the Court that a direction can be issued to Respondents No. 1 and 2 to blacklist Respondent No. 3 in exercise of its power of judicial review under Article 226 of the Constitution of India. Moreover, the crux of the dispute between the Petitioner and Respondent No. 3 apparently seems to be running of a college on a land, which according to Respondent No. 3 is subject matter of litigation between the parties in Title Suit No. 32/2018 pending in the Court of Sub Judge, Sikrahana, Bihar. The said suit is filed by the Petitioner claiming title to the suit land and as per order dated 23.06.2018, copy of which is handed over in Court, Court has, in fact, restrained the Petitioner from obstructing the possession of Respondent No. 3 over the suit land till further order.
3.
In light of this, the present petition cannot be entertained and is accordingly dismissed along with the pending application.
