By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner seeks quashing of FIR No.53/2026 dated 20.03.2026 registered at PS: Kirti Nagar, West Delhi under Section 69 of the Bharatiya Nyaya Sanhita, 2023 (BNS) and all proceedings emanating therefrom since the petitioner and the respondent no.2 have settled all their disputes in view of the Compromise Deed dated 16.05.2026 [Annexure P4] inter se the petitioner and the respondent no.2, which is accompanied by their respective proofs of identity and affidavit(s).

Issue notice. Learned APP for the State accepts notice and submits that though the offences involved herein is grave and serious in nature, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

however, considering the statement of the respondent no.2, he has no objection to the quashing of the aforesaid FIR. 3.

Respondent no.2, present in Court, also accepts notice and affirms the terms of Compromise Deed dated 16.05.2026 whereby the petitioner and the respondent no.2 have settled all disputes inter se themselves and submits that she has no objection to the quashing of the aforesaid FIR. 4.

The petitioner and the respondent no.2, present in Court, as well as their credentials, as on record, have been identified by the IO. 5.

Upon consideration of the peculiar facts and the overall events unfolding in their entirety, even though this Court is mindful that the present FIR No.53/2026 dated 20.03.2026 has been registered under Section 69 of the BNS, this Court is inclined to quash the present FIR in exercise of its inherent powers under Section 528 of the BNSS, particularly, since the respondent no.2 is willing to bring closure to the present proceedings and has given her affidavit to the aforesaid effect and is thus no longer inclined to support the case of the prosecution as also since it will also be in the interest of the parties and betterment of their future. Even otherwise, the respondent no.2 is a young girl of marriageable age with a future prospect ahead. 6.

As such, following the law laid down by the Hon'ble Supreme Court in Gian Singh vs. State of Punjab & Anr.: (2012) 10 SCC 303 and Narinder Singh & Ors. vs. State of Punjab & Anr.: (2014) 6 SCC 466, the present petition is allowed and FIR No.53/2026 dated 20.03.2026 registered at PS: Kirti Nagar, West Delhi under Section 69 of the BNS as also all other proceedings emanating therefrom are hereby quashed.
