O R D E R

The present petition has been filed by the petitioner under Section 439 Cr.P.C. read with Section 482 Cr.P.C. for grant of interim bail for a period of 60 days in case FIR No. 281/2018 dated 05.08.2018, for the offences punishable under Sections 307/147/148/149/120-B IPC and Section 25/27 Arms Act, registered at PS Govind Puri, Delhi. 2.

Learned APP for the State has admitted the fact that the wife of the petitioner is corona positive, however, opposed the present application by stating that the petitioner is involved in two other cases, though on bail. Thus, the present petition deserves to be dismissed. 3.

It is not in dispute that the other co-accused are on interim bail in view of the criteria mentioned in the High Power Committee's Minutes of the Meeting dated 18.05.2020.

As per status report, wife of the petitioner is living alone, although, BAIL APPLN. 2557/2020

mother of petitioner's wife is living nearby at Transit Camp, Govindpuri, New Delhi with her husband and four children who are the brothers and sisters of the petitioner's wife aged about Sanya-18 years, Joya-16 years, Arman-14 years and Rehan-9 years. Therefore, presence of the petitioner is required to look after his wife.

Keeping in view the aforesaid facts, this Court is inclined to grant interim bail to the petitioner for a period of 45 days. 6.

Accordingly, he shall be released on interim bail for 45 days from the date of his release on his furnishing a personal bond in the sum of Rs.15,000/- and with one surety in the like amount to the satisfaction of the Trial Court.

The petition is, accordingly, allowed and disposed of. 8.

Copy of this order be transmitted to the Jail Superintendent concerned and Trial Court for necessary compliance.
