Present Letters Patent Appeal has been filed challenging the impugned order dated 14th March, 2024 passed by the learned Single Judge in OMP (COMM.) 189/2018 and further prays for expediting the hearing of the matter as well as conclusion of the matter in a time bound manner, at the earliest.

Learned senior counsel for the appellant states that he is not seeking pre-ponment of the hearing. He only prays that a direction be passed so that the matter is heard finally on the scheduled date of hearing. He assures and undertakes that the appellant shall not argue for more than one and a half hour.

Learned counsel for the respondent states that she has no objection to the matter being heard on the next date of hearing. She also assures this Court that respondent shall not argue for more than one hour. 4.

Though the present appeal is not maintainable as Letters Patent Appeal, yet it is settled law that nomenclature of a proceeding does not matter. Accordingly, this Court directs the Registry to treat the present Letters Patent Appeal as a FAO(OS).

Further, this Court has no doubt that the learned Single Judge shall make an endeavour on the next date of hearing to expeditiously hear and decide the matter finally in accordance with law, preferably, within three months from the next date of hearing. With the aforesaid request, the present appeal and applications stand disposed of.
