CAV No.113/2016 C.M. No.4544/2016 CM(M) 123/2016 The order impugned before this Court is the order dated 14.9.2015 vide which certain directions were passed by the learned Additional District Judge on the application filed by the plaintiff/petitioner under Order XXXIX Rules 1 and 2 CPC. The Court had not been inclined to pass any order on the pending application as the pleadings were yet to be completed. This order is largely innocuous. Even otherwise an order which has been passed on an application under Order XXXIX Rules 1 and 2 CPC is

an order appealable under Order XLIII of the CPC. Petition is dismissed.
