O R D E R

1. Since Justice S.K. Mahajan, a former Judge of this Court appointed as Arbitrator by this Court on 2nd May 2016, has expired both the parties agree that another arbitrator may be appointed in his place.

2. Accordingly, this Court appoints Justice Sunita Gupta, a former Judge of this Court (Mobile No.9910384628) as a sole Arbitrator to adjudicate the disputes between the parties including their claims and counter-claims. The learned Arbitrator will continue from the stage at which the proceedings were prior to the demise of Justice Mahajan.

3. The order dated 2nd May 2016 passed by this Court shall stand modified accordingly. All other conditions spelt out in the said order, including the conduct of the arbitration proceedings under the aegis of Delhi International Arbitration Centre („DAC‟), shall remain.

4. The petition is disposed of in the above terms. Order be given dasti. A copy of this order and the order dated 2nd May 2016 be delivered to the Additional Coordinator, DAC as well as Justice Sunita Gupta. The Additional Coordinator DAC will get in touch with Justice Sunita Gupta to fix the dates of arbitration.
