% 07.10.2016 CM Nos. 7272/2016 (for restoration) & 7273/2016 (for delay) These applications seek restoration of the petition which was dismissed for non-prosecution and default on 24.11.2015 and condonation of delay, respectively.

There is no opposition to the relief sought. For the reasons mentioned in the applications, the delay is condoned and the petition is restored to its original number and seniority.

The applications stand disposed off accordingly. CM No.37874/2016 (for settlement) The learned counsel for the parties submit that the lis has been settled amicably in terms of the Memorandum of Settlement dated 04.05.2016, which is annexed to this application as Annexure A-1. The monies agreed to in the Settlement have been duly paid to the respondents against receipts,

which are attached to this application.

The learned counsel for the respondents upon instructions confirm that the monies have been received by the respondent and that this Settlement has been made and no further lis survives. The application stands disposed off accordingly. W.P.(C) 1611/2004 & CM No.1316/2004 In the circumstances, the writ petition alongwith pending application is disposed off as being settled in terms of the aforesaid Memorandum of Settlement.
