BAIL APPLN. 153/2017 Learned counsel for petitioner submits that petitioner is the neighbour of the complainant.

Petitioner is having family relations with the complainant. Due to certain misunderstandings, FIR has been lodged by the complainant. With the intervention of common family friends, matter has been settled between the petitioner and complainant. Learned Additional Public Prosecutor has opposed the grant of anticipatory bail to petitioner. She submits that complainant is aged about 13 years. Complainant has alleged in the FIR that petitioner, along with his

friend Vijay (co-accused), stopped her on the occasion of New Year. Coaccused Vijay caught hold of her hand and petitioner caught hold of her cycle. Petitioner and co-accused Vijay were under the influence of liquor. When the complainant raised alarm, they left her. However, they threatened that they will kill her sister Saifali.

Complainant is present in Court along with her sister and father. They submit that complainant is aged about 15 years and her date of birth is 8th November, 2001. It is submitted that matter has been settled with the intervention of the common family friends. Petitioner is the neighbour. Coaccused Vijay is also known to them. Father of the complainant submits that co-accused Vijay is also having family relations with him. Keeping in mind the totality of facts and circumstances, as detailed above, it is ordered that in case of arrest, petitioner be released on bail, subject to his furnishing a personal bond in the sum of `25,000/- (Rupees Twenty Five Thousand Only) with one surety of the like amount to the satisfaction of Arresting Officer/Investigating Officer/SHO concerned.
