As per the last order of this court dated 25.5.2017 an attempt to try and settle the matter was to be made. A direction was given to the respondent to bring a bankers' cheque of Rs.8 lacs. The cheque has not been brought by the respondent.

This is a petition filed under section 11 of the Arbitration and Conciliation Act, 1996 seeking appointment of an Arbitrator. The parties have entered into an agreement on 1.1.2010 whereby the petitioner was to provide "housekeeping services including provisioning of manpower and technical services" at various sites. The petitioner claims an outstanding payment of Rs.65,82,337/-.

The agreement between the parties dated 1.1.2010 has an arbitration clause which states that all disputes and controversies shall be referred to the Sole Arbitrator to be appointed by the respondent. The petitioner has invoked the arbitration clause vide notice dated 24.11.2016.

Learned counsel for the respondent submits that he has no objection in case this court wants to appoint an Arbitrator. 5.

Accordingly, Ms. Aruna Tiku, Advocate (Mob.9810104685) is appointed as the Sole Arbitrator to adjudicate the disputes between the parties. The arbitration shall be held under the aegis of the Delhi International Arbitration Centre. A copy of this order be sent to the DIAC. 6.

Petition stands disposed of. All pending applications, if any, also stand disposed of.
