By way of the present petition, the petitioners seek quashing of the FIR bearing No. 684/2021, registered at Police Station Rajouri Garden, Delhi, for the commission of offences punishable under Sections 288/337/304A of the Indian Penal Code, 1860 (hereafter 'IPC') and all consequential proceedings emanating therefrom on the basis of settlement arrived at between the parties.

All the petitioners and legal heirs of the deceased i.e., respondent no.s 2 to 5 are present before this Court and have been identified by their counsel and Investigating Officer (IO) concerned, Police Station, Rajouri Garden, Delhi.

Briefly stated, the present FIR was registered on the basis of the statement of Respondent No. 2/complainant namely Mr. Vinod. It is alleged that on 05.08.2021, the complainant along with his friend Lakhan was carrying out cement plaster work on the second floor of the building belonging to the petitioners. At about 5:15 PM, the bamboo pole platform tied with ropes allegedly broke, causing both of them to fall to the ground. It is alleged that Lakhan sustained grievous head injuries after hitting the concrete floor and subsequently succumbed to his injuries at DDU Hospital, while the complainant sustained serious injuries. The complainant further alleged that the petitioners, being the building owners, had failed to provide safety equipment such as helmets, safety jackets and other construction safety measures, and due to the weakening/melting of the ropes in the rain, the accident occurred. It is stated that with intervention of the family and friends, the parties have now amicably settled their dispute vide Memorandum of Understanding (MoU) dated 02.05.2026. 7.

On a query made by this Court, respondent nos. 2 to 5 who have been identified by the IO, have categorically stated that they have entered into compromise out of their own free will and without any pressure, coercion or threat. It is also stated that respondent no. 3 has received an amount of Rs. 2,00,000/- vide Demand Draft (DD) bearing no. 581172 dated 19.05.2026 and DD bearing no. 581177 dated 27.05.2026, respondent no. 2 has received an amount of Rs. 1,50,000/- vide DD bearing no. 001093 dated 19.05.2026, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

respondent no. 4 has received an amount of Rs. 50,000/- vide DD bearing no. 003253 dated 19.05.2026 and respondent no. 5 has received an amount of Rs. 10,000/- vide DD bearing no. 581173 dated 19.05.2026 and . Therefore, she has no objection if the present FIR is quashed. 8.

In view of the above, that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 9.

Accordingly, FIR bearing No. 684/2021, registered at Police Station Rajouri Garden, Delhi, for the commission of offences punishable under Sections 288/337/304A of IPC and all consequential proceedings emanating therefrom are quashed.

Accordingly, the petition stands disposed of. 11.
