CM(M) 828/2019, CM APPL.No.25214/2019 The petitioner has filed an application under Order XXXVII Rule 4 CPC for setting aside the decree dated 26.05.2018 passed under Order XXXVII CPC. The execution has been filed and warrants of attachment of immovable property of the petitioner has been issued. This application under order XXXVII Rule 4 CPC was though argued on 03.04.2019 but the order has not been pronounced as yet and the matter is listed before ACJ for appointment of the bailiff on 31.05.2019 hence it is requested the application be decided prior to the said date.

In the circumstances issue notice to the respondent through all modes returnable on 27.05.2019 before the learned District Judge and

the application be decided by the learned District Judge on the same day i.e. on 27.05.2019 and/or prior to 31.05.2019. In the circumstances the petition alongwith the pending applications, if any, stands disposed of.

Copy of this order be given dasti under signature of the Court Master.
