A Writ Petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner for grant of first spell of furlough for a period of three weeks in case FIR No.50/2008 under Section 302, 364, 392, 394, 201 and 34 IPC Police Station Palam Airport. 2.

It is submitted that the Application was filed on 04.04.2026, but the same has not been decided till date.

Learned APP for State states that the Petitioner is facing conviction in two cases and presently he is undergoing sentence in FIR No.94/2001 P.S. Delhi Cantt and the Sentence in the present FIR No.50/2008 P.S. Palam Airport would commence after the sentence in the first FIR is concluded. Because the Petitioner is not undergoing sentence in the present FIR, his Application is not maintainable.

Be as it may, the Respondent is directed to dispose of the Representation within fifteen days.
