% 11.09.2020 Status report dated 'nil' has been filed. It inter alia says that the video clip cited before the court and furnished to the Investigating Officer (I.O.) is only 39 seconds long. It is further recorded that the video clip is not complete; and the device on which it was recorded has not been handed-over. The authenticity of the video clip has also been doubted.

Ms. Neelam Sharma, learned APP for the State submits that as per directions of this court, the applicant joined investigation on 09.09.2020 but did not co-operate and gave vague answers ; that the video clip confirms the presence of accused persons, in particular the applicant, at the complainant's office. She also submits that the applicant has not been able to explain the reason for his presence at the complainant's office.

On the other hand, Mr. Anurag Jain, learned counsel for the applicant has sent via e-mail another version of the same video clip, purporting to show the date and time of the recording, in an attempt to belie the allegations contained in the FIR.

After making some submissions, Mr. Jain seeks leave to withdraw the present bail application with liberty to file afresh, at the appropriate stage, in accordance with law.

The application is accordingly dismissed as withdrawn. 6.
