% 01.02.2016 Present writ petition has been filed seeking quashing of the disciplinary proceedings arising out of the letter dated 5th June, 2012 issued by the respondent - ICAI, whereby the respondent stated that newspaper reports have come to its attention wherein fraud has been alleged to have been committed by the petitioner and requested the petitioner to send his response to such allegations. Learned counsel for the petitioner states that the newspaper reports cannot form the basis of any disciplinary proceedings against any member of the ICAI.
A perusal of the paper book reveals that the aforesaid issue has been raised by the petitioner in the proceedings pending before the respondent.
Mr.J.S.Bakshi, learned counsel for the respondent states that all
issues including the aforesaid issue raised by the petitioner shall be decided by the Disciplinary Committee of the respondent by way of its final order.
The statement made by learned counsel for the respondent is accepted by this Court and the respondent is held bound by the same. In view thereof, the present writ petition and the applications are disposed of.
