The petitioner has filed the present petition, inter alia, praying that the FIR No. 40/2018 under Sections 420/467/468/471/34 IPC registered at P.S. Prashant Vihar, District Rohini be quashed.

It is pointed out by the learned APP appearing for the State that the petitioner has been declared a proclaimed offender. He has also jumped parole. In addition, it is stated that there are other cases also pending against the petitioner.

Given these facts, this Court is of the view that it would not be apposite for this Court to entertain this petition unless the petitioner surrenders before the concerned authorities. The conduct of the petitioner cannot be countenanced.

Mr Ramesh Gupta, learned Senior Counsel appearing for the petitioner states that the petitioner has already paid a sum of ₹1.5 lakhs to the complainant as per the agreement arrived at between the parties. The same is not material considering the conduct of the petitioner. 5.
