% 13.08.2019 C.M. No. 36167/2019 Issue notice. Mr. Singh accepts notice on behalf of the respondents. The petitioners have preferred the present application to seek leave to withdraw the present petition with liberty to file an application before the Tribunal to seek protection that the new recruitment process undertaken by the respondents herein would not frustrate the rights & contentions of the petitioners as pronounced by the Tribunal vide order dated 03.05.2019 in O.A. No. 1391/2019. The petitioners also state that the petitioners would seek interim relief for reservation of seats for them, out of the seats advertised, till the decision is taken with respect to the petitioners. Mr. Singh submits that the observations made by this Court in its order dated 24.05.2019 may not come in the way of the Tribunal in deciding
the application that the petitioners propose to file for the aforesaid reliefs. Considering the aforesaid, we permit the petitioners to withdraw the writ petition with liberty as prayed for. The observations made in our order dated 24.05.2019, being only tentative, shall not come in the way of the petitioners in any way.
