By way of the present petition, the petitioners seek quashing of FIR bearing no. 138/2024, registered at Police Station Chitranjan Park, New Delhi, for the commission of offences punishable under Sections 498A/406/34 of Indian Penal Code, 1860 (hereafter 'IPC') and the proceedings emanating therefrom.

The petitioners and respondent no. 2 are present through video conferencing before this Court and have been identified by their counsels and concerned Investigating Officer (IO) from Police Station Chitranjan Park, New Delhi.

Brief facts of the present case are that the marriage between petitioner no. 1 and respondent no. 2 was solemnized on 07.04.2010, as per Hindu rites The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
and customs at New Delhi. It is stated that two children were born out of the said wedlock, who are presently in the custody of respondent no. 2. Due to temperamental differences, parties have been residing separately. It is stated that on the complaint of respondent no. 2, the present FIR was registered against the petitioners.

During pendency of the case, both the parties had amicably settled their disputes vide Memorandum of Settlement/Release Deed dated 06.05.2026.

Both the parties are non-resident of India and have submitted themselves to the jurisdiction of the Federal Circuit and Family Court of Australia (Division 1) at Melbourne wherein a detailed comprehensive final parenting orders as well as the other comprehensive Memorandum of Settlement/Release Deed dated 06.05.2026 have been drawn. The parties have appeared through Video-Conferencing (VC) and have been identified by the I.O. concerned. The parties state that they have submitted to the jurisdiction of the above mentioned Court and will remain bound by the MoU entered into by them.

In view of the above fact that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no other legal impediment in quashing the FIR in question.
