In view of the fact that the respondent is a body corporate, incorporated outside India, the proposed arbitral proceedings fall within the definition of an "International Commercial Arbitration" under Section 2(1)(f)(ii) of the Arbitration and Conciliation Act, 1996. 2.

Mr. Wajeeh Shafiq, learned counsel for the petitioner, therefore, seeks permission to withdraw these petitions with liberty to approach the Supreme Court on the same cause of action.
