% 07.02.2020 The only objection in this case is in respect of the belated filing of the written statement. On 11th September, 2018, the Plaintiff's/Petitioner's (hereinafter, "Plaintiff") counsel had not objected to the written statement being taken on record, subject to costs of Rs. 25,000/- and the matter was adjourned to 8th January, 2019. Thirty days' time was given to file the written statement; however, the written statement was presented on the next date i.e., on 8th January, 2020.

Considering that the suit was not registered as a commercial suit and the procedure as per the Commercial Courts Act was not yet followed in this matter, either in the pleadings or in the procedural orders passed, the written statement is directed to be taken on record, subject to payment of Rs. 10,000/- as costs to be paid to the Plaintiff. The suit shall now proceed further in accordance with law after now numbering/registering the suit as a

commercial suit.

Accordingly, the petition and all pending applications are disposed of. PRATHIBA M. SINGH, J.
