O R D E R

This application has been filed under Section 439 read with 482 of the Code of Criminal Procedure, 1973 (in short, 'Cr.P.C.') praying for the applicant to be released on interim bail for a period of (30) thirty days in FIR No.0148/2023 registered at Police Station: Chitranjan Park, South-District, New Delhi under Sections 307/34 of the Indian Penal Code, 1860 (in short, 'IPC') and Sections 25/27/54/59 of the Arms Act, 1959 (in short, 'Arms Act'). 2.
It is the case of the applicant that his son aged around 11⁄2 years is suffering from 'jaundice with high fever' and requires special care and admission in the hospital. It is further stated that there is no other family member available to give care and protection to the child in his medical emergency.

A verification report/status report has been filed which inter alia states that the medical documents have been duly verified and found to be genuine. As far as the other family members are concerned, the applicant has a younger brother who resides with the family of the applicant and can take care of the son of the applicant. 5.
I have perused the status report and considered the submissions made.

From the medical record that has been duly verified, it is evident that the son of the applicant is facing medical emergency. Though the applicant has a younger brother, his son would require the presence and care of the father in such medical emergency. 7.
Keeping in view the above facts and circumstances, the applicant is directed to be released on Interim Bail in case FIR No.0148/2023 for offence under Sections 307/34 of the IPC and Sections 25/27/54/59 of the Arms Act registered at Police Station: Chitranjan Park, South-District, New Delhi, for a period of thirty (30) days from the date of his release, on furnishing a personal bond in the sum of Rs.10,000/- with one local surety of the like amount to the satisfaction of the learned Trial Court and further subject to the following conditions:
i. The Applicant shall not move out of the National Capital Region without the prior permission of the learned Trial Court. ii. The Applicant shall provide his permanent address to the learned Trial Court. iii. The Applicant shall appear before the learned Trial Court as and when the matter is taken up for hearing.
iv. The Applicant shall provide all/latest/fresh mobile numbers to the IO concerned, which shall be kept by the Applicant in a working condition at all times and shall not be switched off or changed by his without prior intimation to the learned Trial Court and the IO concerned.
v. The Applicant shall not indulge in any criminal activity and shall not communicate with or come in contact in any manner with the prosecution witnesses or tamper with the evidence of the case while being released on interim bail. 8.
It is made clear that no extension of this relief shall be granted to the applicant on any ground and, upon expiry of the period of interim bail, the Applicant shall surrender before the concerned Jail Superintendent.

The application is disposed of in the above terms. 10.
Copy of this order be also sent to the Jail Superintendent for necessary compliance.
