O R D E R

By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 read with Article 227 of the Constitution of India, the petitioner seeks the following reliefs: "a) Quash and set aside the entire criminal proceedings arising out of FIR No. 39/2008, instituted on 29.01.2008 in PS Kalyan Puri, Delhi under sections 279/304A/337 IPC against the petitioner and accordingly and to quash the consequent trial being pending before the Court of the Ld Chief Judicial Magistrate, East, Kadkaddooma Courts as Crl. C No. 6946/2016, on account of the inordinate delay of over 18 years in conclusion of trial, which has been caused exclusively due to the failure of the prosecution to produce its witnesses; or The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. b) Alternatively, pass a direction to the leamed trial court ie Court of Ld CJM, East Delhi at Kadkaddooma Courts to conclude the entire trial ie Crl Case No 6946/2016 (arising out of the FIR No 39/2008, registered with PS Kalyan Puri, East Delhi) within a strictly time-bound period time period as this Hon'ble Court may deem fit and proper in the interest of justice; and/ or"

After some arguments, learned counsel for the petitioner seeks to withdraw the present petition with liberty to seek appropriate remedies in accordance with law before the learned Trial Court. 3.

The present petition, alongwith the pending applications, is dismissed as withdrawn with liberty as prayed for. 4.

However, considering the inordinate delay of eighteen years before the learned Trial Court in the proceedings emanating from the FIR No.39/2008, the learned Trial Court is requested to conclude the proceedings as expeditiously as possible, preferably on or before 31.12.2026.
