ARB. P. 365/2020 The present petition has been filed by the petitioner for appointment of an Arbitrator. Admittedly, the invocation of the arbitration clause was vide letter dated August 18, 2020.

Mr. Sumit Roy, learned counsel appearing for the respondent states that the notice of invocation was received by the respondent only on August 20, 2020 and the period of 30 days have still not expired. In other words, he states that the present petition is premature.

Mr. Anand conceding that the petition is premature, wishes to withdraw the petition with liberty that if any cause survives for the petitioner, to approach this Court. Giving liberty to the petitioner to approach this Court, if any cause survives, the petition is dismissed as withdrawn.
