Vide order dated 29.04.2025, the learned Predecessor Bench of this Court had passed the following order: - "CM APPL. 25328/2025 (Exemption) 1.
Exemption allowed subject to just exceptions. 2.
Application stands disposed of, accordingly.
CONT.CAS(C) 662/2025 1.
This petition has been filed alleging wilful disobedience of order dated 11th November 2024, passed in W.P.(C) 15645/2024. Relevant directions passed by the Court are as under: The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Counsel for the Municipal Corporation of Delhi ('MCD') appears on advance notice and states that demolition action was taken on 24th April 2025, pursuant to a demolition order dated 20th November 2024.

During demolition action, three RCC panels were demolished on the ground floor slab and steel bars were cut. On the same date, a Watch and Ward Letter were sent to SHO, P.S Jaitpur as well. Photographs have been handed up along with the Watch and Ward Letter as well.

The same shall be filed on record as part of the status report, and a copy thereof shall be given to counsel for petitioner. 5.
It is also stated that an appeal has been moved by owners/occupiers before the Appellate Tribunal for Municipal Corporation of Delhi (ATMCD). Matter is still pending. However, no stay has been granted.

Counsel for MCD further states that further demolition action has been planned for 02nd May 2025 and 15th May 2025. 7.
Status report shall be filed on or before 30th May 2025, updating the action which will be taken on 02nd May 2025 and 15th May 2025.

Objections to the same shall be filed by petitioner along with relevant photographs.

Learned counsel for the MCD submits that subsequently vide order dated 15.05.2025, the learned Appellate Tribunal in Appeal No. 1050/ATMCD/2024 have set aside the order dated 20.11.2024 and remanded back the matter to MCD for deciding the same afresh. It is further submitted that the matter is still pending.

In view of the above, learned counsel for the petitioner does not wish to press the present petition at this stage with liberty to revive the present petition after speaking order is passed by the MCD with respect to the unauthorised construction.

Leave and liberty granted.

The present petition is dismissed as not pressed and disposed of accordingly.
