Learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file an appropriate application before the Ld. Trial Court for recalling of the process under Section 82 & 83 Cr.P.C. Liberty granted.

In view of the above, the present petition alongwith pending application stands dismissed as withdrawn.

However no coercive action shall be taken for thirty days. In the meantime, learned counsel for the petitioner may move an appropriate application before the Ld. Trial Court.
