The petitioner seeks regular bail under Section 439 Cr.P.C in case FIR No. 208/2011 under Section 302/364/201 IPC registered at Police Station Vasant Kunj (South). Status report is on record. 2.

I have heard the learned counsel for the parties and have examined the trial court record. The petitioner is in custody since 23.08.2011. The case of the prosecution is based upon circumstantial evidence only. Out of 23 witnesses, 14 witnesses have been examined. The material allegations against the petitioner are that as per the Call Detail Report, the deceased and the victim were found at the same location i.e. Lakshman Jhula, Rishikesh, Uttrakhand on Bail Appln. 220/2016

07.08.2011 at around 5:26 pm. The petitioner and the complainant were acquainted with each other and there existed physical relations between the two. FIR was lodged by her after the delay on 14.08.2011. The dead body of the victim could not be recovered. 3.

Considering the facts and circumstances of the case, the petitioner is admitted to bail on his furnishing personal bond in the sum of Rs.75,000/- with one surety in the like amount to the satisfaction of the Trial Court.

The bail application stands disposed of.
