The present application has been filed by the Petitioner under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the "BNSS"), seeking grant of interim bail to the Applicant/Petitioner on medical grounds in FIR No. 19/2026 dated 29.01.2026 registered at Police Station Crime Branch, Delhi for the offences punishable under Sections 22/25/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as the "NDPS Act"). The following prayers are set out below:- "a) Grant interim bail to the Applicant for a period of 4 months on medical grounds;

b) Permit the Applicant to undergo treatment at a specialized private hospital of his choice at his own expense;

c) Pass any other order(s) as this Hon'ble Court may deem fit and proper in the interest of justice." The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Learned counsel for the Applicant/Petitioner submits that, as per the medical status report filed by the jail authorities, the blood report is suggestive of Hepatitis C, which may lead to liver cirrhosis if the Applicant/Petitioner is not given due treatment. He further submits that the Applicant/Petitioner is not able to digest anything due to his liver malfunctioning and vomits out everything he eats.

Learned APP for the State submits that Hepatitis C is not a communicable disease and that the Applicant/Petitioner can be provided appropriate treatment in jail.

Considering the medical condition of the Applicant/Petitioner, this Court deems it appropriate to grant interim bail to the Applicant/Petitioner for a period of one month from the date of his release, subject to the following conditions:

i.

The Appellant shall be released upon furnishing a personal bond for a sum of Rs. 10,000/-, with a surety of the like amount, to the satisfaction of the Trial Court.

ii.

The Appellant shall not leave the country without prior permission of this Court;

iii.

The Appellant shall intimate the concerned SHO, PS Crime Branch, regarding any change in residential address; iv. The Appellant shall provide his mobile number to the concerned SHO, PS Crime Branch and intimate about change in the number, if any;

v. The Appellant shall report at the office of concerned SHO, PS Crime Branch first Monday of every month at 11:00 a.m. and he shall be discharged by 12 noon, after recording his presence and completion of The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The Appellant shall not indulge in any criminal activity and upon any such activity being discovered or indulged into, the present suspension of sentence shall automatically stand cancelled. 6.

The application is allowed in the above terms and disposed of accordingly. Pending application(s), if any, is also disposed of. 7.

The observations made in this order shall not affect the final hearing in the appeal.

A copy of this order be sent to the concerned Jail Superintendent for necessary information and compliance.
