The present writ petition under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 20231 (corresponding to Section 482 of Code of Criminal Procedure, 19732) seeks quashing of FIR No. 0067/2020 dated 02nd March, 2020, under Sections 182, 505(1) and 505(2) of Indian Penal Code, 18603, registered at P.S. Govind Puri, New Delhi, as well as proceedings arising thereof. The aforenoted FIR has been lodged against the Petitioner, on behalf of the State of GNCTD, for spreading false rumours of purported communal violence and arson.

Through this petition, the Petitioner contends that he has compromised the matter with Respondent No. 2, who is his niece, and is 1 "BNSS"

impleaded as a witness in the chargesheet. However, in the opinion of the Court, the request for quashing of the FIR on the basis of the consent of Respondent No. 2, who is only a witness in the chargesheet, cannot be entertained.

In light of the above, after making some submissions, counsel for the Petitioner states that he would like to withdraw the present petition. 4.

Dismissed as withdrawn. The pending applications are disposed of. 5.

It is made clear that this Court has not commented on the merits of the case and all rights and contentions of the parties are left open.
