% 28.05.2024 Matter is taken up through physical hearing as well as video conferencing.

This is fresh petition u/S. 27 of Arbitration and Conciliation Act. Heard. As per document no.8 (page no. 49 to 51) of the petition, Order dated 04.04.2024 has already been passed by the Ld. Sole Arbitrator giving permission to the applicant to file the present petition for summoning the two witnesses as mentioned below :

(i) Mr. Dnyaneshwar Ashok Gajare, Proprietor of M/s Orchid Crop Science having his registered office at Samarth Industries, Plot No.

J19, Malegaon, Sinnar;

Nashik, Maharashtra-4221 03 along with audited balance sheets of his proprietorship firm pertaining to financial years 2019-20, 2020-21 and 2021-22; and O.M.P. (ii) Concerned accountant/official from M/s Grasim Industries Limited having its registered office at P.D.Birlagram, Nagda - 456331, Dist. Ujjain, Madhya Pradesh along with audited balance sheets of Mis Grasim Industries Limited pertaining to Financial Years 2019-20, 2020-21 and 2021-22. Ld. Counsel for petitioner has stated that there is urgency in the matter as the next date for evidence before Ld. Sole Arbitrator is 06.07.2024. Keeping in view the facts and circumstances mentioned in the petition, the petition is allowed and concerned official of Registry is directed to issue summons to the abovesaid witnesses as per the address mentioned in the petition, on filing of PF within one week by all modes including electronic mode and dasti, if any, for appearance for evidence before the Ld. Sole Arbitrator on 06.07.2024. The said summons shall be valid for any subsequent dates before the Arbitral Tribunal as well. In view of the urgency of the matter, Ld. Counsel for the petitioner shall follow upon with the Registry for issuance of summons.
