By way of present petition, the petitioners have assailed the order dated 24.05.2023 passed by learned ASJ in Crl. Appeal No. 81/2023 to the extent that petitioners/accused have been asked to deposit 20% of the compensation amount.

The present petition came up for consideration on 04.07.2023 when this Court after noting the submissions of learned counsel for the petitioners that the petitioner No.1 is facing financial crisis as his father has been diagnosed with terminal stage of cancer and his son is autistic, directed the petitioners to deposit 10% of the fine/compensation with the Ld. Principal District and Sessions Judge (East).

Learned counsel for the petitioners informs that petitioner No.1 has complied with the aforesaid directions. He further submits that appeal has been listed for remaining final arguments on 10.05.2024 before the Ld. Mr. Bhardwaj, learned counsel for the respondent also confirms that the matter is to be finally heard by the Appellate Court. He further submits that in view of the stage of the proceedings, he has no objection to the prayer made in the petition.

In view of the aforesaid, petition is disposed of. The Appellate Court shall make an endeavor to conclude the proceedings at the earliest. Miscellaneous application is disposed of as infructuous.
