% 27.05.2019 C.M. No. 25568/2019 Exemption allowed, subject to all just exceptions. The application stands disposed of.

W.P.(C) 5891/2019 Issue notice. Counsel for the respondent accepts notice. The petitioner assails the order dated 24.04.2019, passed by the Central Administrative Tribunal, Principal Bench, New Delhi, (the Tribunal) in O.A. No. 4061/2014. The Tribunal has disposed of the petitioner's Original Application by placing reliance on the order passed in O.A. No.

4533/2014 on 28.03.2019.

The submission of learned counsel for the petitioner is that the decision in O.A. No. 4533/2014 was assailed before this Court in W.P. (C.) No. 4896/2019. The same was disposed of by this Court vide order dated 08.05.2019. This Court had remanded back the said Original Application for re-consideration by the Tribunal.

Accordingly, we set aside the impugned order and remand the case back to the Tribunal.

List the O.A. No. 4061/2014 along with O.A. No. 4533/2014 before the Tribunal on 28.05.2019.
