This petition is preferred on behalf of the Petitioner under Section 29A (4) and (5) of Arbitration and Conciliation Act, 1996 ('1996 Act') seeking extension of mandate of learned Arbitral Tribunal upto 31.12.2025. 4.

Petitioner was appointed as EPC Contractor by the Respondent for carrying out works under the Project Highway for purpose of development of Four Laning of Jetpur-Somnath Section of NH-8D (now NH-151) from KM 0.000 to KM 127.60 in the State of Gujarat. 13.08.2011. Disputes having arisen between the parties herein, a 3-Member Arbitral Tribunal was constituted on 29.03.2023 and it is stated in the petition that the arbitral proceedings are at the stage of final arguments, which are scheduled from 02.05.2025 to 24.05.2025. The mandate of the Arbitral Tribunal has expired on 24.04.2025.

Issue notice.

Ms. Tara Shahani, learned counsel accepts notice on behalf of the Respondent and on instructions, submits that Respondent has no objection if the mandate of the learned Arbitral Tribunal is extended, albeit the allegations made by the Petitioner in the petition against the Respondent are strongly refuted.

Accordingly, with the consent of the parties, mandate of the learned Arbitral Tribunal is extended upto 31.12.2025 from 25.04.2025. It is made clear that this extension is without entering into the merits of the dispute or the allegations in the petition, which the Respondent is at liberty to refute before the learned Arbitral Tribunal.

Petition is disposed of in the aforesaid terms.
