The instant appeal has been filed by the Appellant under Section 13 of Commercial Court Act, 2018 read with Section 96 CPC against the impugned Order dated 14.02.2023 passed by the Ld. District Judge (Comm. Judge-2) Shahdara Karkardooma Courts, Delhi in CS (COMM) No.253/2022.

It is stated that pending the appeal, the parties have entered into a settlement and therefore, the instant appeal has been rendered infructuous. 3.

In view of the above, the instant appeal is disposed of as having become infructuous along with pending application(s), if any. 4.

It is open for the Appellant to move an application under Section 16 of the Court Fees Act, 1870 seeking refund of court fees.
