There is no objection if the petitioners are permitted to vend at a site, except in and around Kalkaji Mandir and non-vending zones. 2.

The fact remains that petitioners are already subjected to survey except Mr. Babban Singh/petitioner no. 7.

In such an eventuality, we permit the petitioners to vend in accordance with the vending scheme that too in an area where the vending is permitted. 4.

petitioner no.7, the area in which they can carry out their vending activity, if they have been issued provisional vending certificates. 5.

The aforesaid order is passed keeping in mind the responsibility of respondents to resettle the petitioners after having unsettled them for the purpose of development of the area in and around Kalkaji Temple. 6.

As far as the claim of petitioner no.7 is concerned, the counsel for petitioner have sought to rely upon the earlier receipt/challan. 7.

The counsel for the respondent submits that the claim of the petitioner no. 7 shall be independently considered and the decision shall be communicated to petitioner within a period of eight weeks from today. 8.

The place where the petitioners will be permitted to vend, as an interim measure, as is permitted through present petition, shall not create any vested right in them to have vending certificate for a particular area or a place. 9.

Accordingly, the writ petition stands disposed of. 10.
