O R D E R

% 27.05.2019 Vide the present petition, the petitioner seeks direction thereby quashing the order dated 20.02.2018 passed by the respondent and direct the respondents to promote the petitioner on the post of Assistant Librarian reserved for SC category.

It is admitted by the petitioner that on February 20, 2018, the petitioner was not having MA Degree, therefore, was not qualified for the post in question. However, he submits that thereafter, the petitioner completed his Post-Graduation in Political Science, the details which are placed at page 97 of the instant petition. Accordingly, the counsel for the petitioner submits that petitioner may be considered by the respondent for the aforesaid post as now he is eligible.

Learned counsel appearing on behalf of the respondent on advance notice submits that the post in question is reserved for SC Category and still

lying vacant, therefore, considering his MA Degree which is in Political Science, the DPC shall take final decision, subject to the condition if the petitioner is otherwise eligible for the said post. Accordingly, the present petition is disposed of directing the respondent-University to put up the case of the petitioner within two weeks before the DPC and the DPC shall take a final decision as per the rules applicable upon the petitioner within four weeks thereafter. The decision taken shall be communicated to the petitioner within one week thereafter. I hereby make it clear that the post reserved for the SC category shall not be filled by the unreserved category.
