Learned counsel for the defendants submits that in the rectification petitions, which were pending with regard to the mark which is subject matter of the present suit, it has been categorically held that the mark of the defendants, is not identical or deceptively similar to the mark of the plaintiff. 2.

He further submits that he has instructions to state that the defendants herein, in view of the favourable orders in their favour in the rectification petitions, do not intend to initiate any further litigation against the plaintiff herein with regard to any damages for the mark, which is the subject matter of the present suit, or relating to any proceedings, with regard to the present suit.

Accordingly, learned counsel for the plaintiff submits that in view of the orders passed in the rectification petitions, he shall withdraw the present suit.
